Painter sues homeowners over nail hidden in grass

EDWARDSVILLE — A painter has filed a lawsuit against two Alton homeowners after he stepped on a nail that was hidden in grass.

The suit was filed against Carl E. Kesler and Linda S. Kesler.

Dennis Hayes filed the complaint on July 30 in Madison County Circuit Court claiming the property owners carelessly allowed nails in the grass and did not warn him about the danger. 

According to the complaint, the homeowners hired Hayes to paint the foundation at their house when he was injured. He suffered pain and suffering, lost wages and disability, the complaint states. 

Hayes seeks a jury trial and damages of more than $50,000. He is represented by Rodney D. Caffey and Ralph J. Mendelson of The Caffey Law Firm in Godfrey.
