Suit alleges 5th Quarter Pub & Grill failed to make payments on loan

BELLEVILLE — A bar and grill is being sued for allegedly failing to make payments. 

Danny Boozers LLC filed a complaint on July 30 in the St. Clair County Circuit Court against 5th Quarter Pub & Grill LLC, Michael D. Miller and Karen L. Miller, alleging they failed to make payments when due and payable.

According to the complaint, the plaintiff alleges that on Feb. 21, 2017, the defendants executed a promissory note and guaranty through which the plaintiff financed a portion of the purchase price to the sale of the plaintiff's assets. To date, the principal amount of $41,952.73 remains due and owing. 

The plaintiff alleges that despite repeated demands for payments, the defendants failed to pay all sums due and owing under the note.

The plaintiff requests a trial by jury and seeks judgment against the defendants for a sum exceeding $50,000, plus interest, attorney's fees, costs and all other additional relief deemed just and proper. He is represented by Clay B. St. Clair of Crowder & Scoggins Ltd. in Columbia.
