Driver sued over fatal Godfrey collision

EDWARDSVILLE — An independent administrator is suing a driver for allegedly causing a fatal collision on Interstate 255. 

Joanie Hall, as independent administrator of the estate of Charlene G. Nickens, filed a complaint on July 26 in the Madison County Circuit Court against a minor driver, alleging the driver breached a duty to operate a vehicle with reasonable care.

According to the complaint, the plaintiff alleges that on Jan. 17, Nickens was traveling south and merging onto Interstate 255 in Godfrey when the defendant struck her vehicle from behind with great force. 

Hall claims she suffered severe and debilitating injuries, including head trauma with concussion, C5 and C6 fractures, left pubic body fracture and right sacral fracture. She later died as a result of her injuries. 

The plaintiff alleges the defendant drove a vehicle at an excessive speed, failed to keep proper lookout and failed to maintain her vehicle under control.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000, plus costs and all other relief that are proper and just. She is represented by Eric J. Carlson of Byron, Carlson, Petri & Kalb LLC in Edwardsville.
