Consumer claims Hudson River Foods products are falsely advertised as natural

BELLEVILLE – A St. Clair County woman alleges a brand of baking goods is not all natural as advertised.

Judy Kremmel, individually and on behalf of all others similarly situated, filed a complaint on June 8 in the St. Clair County Circuit Court against Hudson River Foods Corp. citing the Illinois Consumer Fraud and Deceptive Business Practices Act.

According to the complaint, the plaintiff alleges that in March and April 2016, the plaintiff bought defendant's gluten-free yellow cake mix and gluten-free RTS Chocolate Frosting at Fresh Thyme in Fairview Heights after reviewing the products' all-natural label. She alleges the products are deceptively and falsely advertised as all-natural because they contain synthetic ingredients such as xanthan gum and citric acid.

The plaintiff holds Hudson River Foods responsible because the defendant allegedly misled customers into purchasing products that are not what they are represented to be and exposed them to unwanted synthetic ingredients.

The plaintiff requests a trial by jury and seeks an order certifying this case as a class action and appointing the plaintiff and her counsel as representatives, an award for compensatory damages, pre- and post-judgment interest, attorney fees, costs and all other relief deemed proper.
