Kansas City Southern Railway accused of not paying $171K medical bill as agreed

BELLEVILLE — A former engineer claims a railroad company failed to pay a medical bill as part of a settlement agreement.

Michael J. Smith filed a complaint April 27 in the St. Clair County Circuit Court against The Kansas City Southern Railway Co. alleging it violated the Federal Employers' Liability Act.

According to the complaint, the plaintiff alleges that on Dec. 9, 2016, he entered into mediation with the defendant to resolve his claim for the injuries he suffered on May 1, 2015. As part of the settlement, the defendant agreed to pay a certain medical bill totaling $171,646.93, the complaint states. 

The plaintiff holds Kansas City Southern Railway Co. responsible because it allegedly violated the terms of the settlement by failing to pay the bill.

The plaintiff seeks an order directing the defendant to pay the full amount of the unpaid medical bills in the amount of $171,646.93, with interest, attorney fees, costs and all other relief that are just and proper. 

He is represented by John P. Kujawski of Kujawski Marcus LLC in O'Fallon.
