EDWARDSVILLE — A Wood River City employee claims he injured his shoulder when he attempted to pick up a bag full of rocks during a yard waste collection.
Benjamin Dona filed a complaint on April 6 in the Madison County Circuit Court against Joanna Hendricks, alleging that the premises controller breached her duty to exercise ordinary care by allowing a bag of rocks to be pick up during a yard waste collection.
According to the complaint, the plaintiff alleges that on May 6, 2016, he attempted to lift a bag of yard waste containing rocks when he hurt his shoulder.
He alleges Hendricks improperly filled the yard waste bag with rocks, failed to label the bag appropriately and failed to warn that the bag was filled with rocks. He also alleges she allowed a bag of rocks to be picked up during a yard waste collection.
As a result, Dona claims he suffered severe and permanent injuries to his shoulder, preventing him from attending to his usual duties and affairs.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000, plus costs of court.
