BELLEVILLE — A property owner is suing former tenants for allegedly failing and refusing to make payments.

Proactive Health Industries LLP filed a complaint on March 28 in the St. Clair County Circuit Court against CBK 100 Corporation and Chris Hartman, alleging they failed to perform their contractual obligations.

According to the complaint, the plaintiff alleges that on June 7, 2016, the defendants agreed to lease the plaintiff's property. However, Proactive Health alleges the defendants failed to make rental payments. The parties entered into a rent repayment agreement wherein the defendants promised to make additional payments in order to catch-up on the overdue rent.

The plaintiff alleges the defendants failed and refuse to make the agreed payments.

As a result, the plaintiff claims it has been damaged in an amount exceeding $50,000, including $36,944.28 in unpaid rental payments.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount in excess of $50,000, and all other relief that are just and appropriate.

It is represented by Brett B. Caban of Aegis Law in O'Fallon.
