East Carondelet homeowner alleges levee district's work resulted in flooded property

BELLEVILLE — An East Carondelet property owner claims a levee district's work caused damage to his home.

Terry Harr filed a complaint March 23 in the St. Clair County Circuit Court against Prairie Dupont Levee District, alleging storm water was a physical invasion of his property after it flooded multiple times following levee work.

According to the complaint, the plaintiff alleges that due to the defendant's work on the levee in 2016 and 2017, storm water was forced into his home, causing property damage and personal property loss. He also claims the storm water turned his yard into a swamp, which promoted insect breeding. 

The plaintiff alleges Prairie Dupont Levee District refused to remedy the problem and failed to pay just compensation equal to the fair market value of the property.

The plaintiff seeks damages of more than $50,000, and all further relief as the court may deem just and proper.
