BELLEVILLE – A couple alleges exposure to asbestos caused the husband to develop lung cancer.
David Bowers and Jacqueline Bowers filed a complaint on Feb. 23 in the St. Clair County Circuit Court against Buffalo Pumps Inc., Dana Cos. LLC, Dow Chemical Co., et al. alleging negligence.
According to the complaint, the plaintiffs allege that at various times during David Bowers' career from 1970 to 2015 he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants. The suit states that on or about Sept. 26, 2017, he first became aware that he had developed lung cancer, an asbestos-induced disease. He alleges he has suffered great pain and anguish, reduced earnings, and a substantial amount of medical expenses.
The plaintiffs hold Buffalo Pumps, Dana Cos., Dow Chemical, et al. responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available, and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
The plaintiffs seek compensatory and punitive damages of more than $50,000. They are represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
