Woman sues Texaco and others over deceased husband's alleged asbestos exposure

BELLEVILLE – A widow alleges her late husband was exposed to asbestos during his employment, which led to him developing cancer and causing his death.

Hattie Mitchell, individually and as special administrator of the estate of Joe Mitchell, deceased, filed a complaint on Feb. 26 in the St. Clair County Circuit Court against Bechtel Corp., Cleaver-Brooks, Texaco Inc., et al., alleging negligence.

According to the complaint, the plaintiff alleges that at various times during Joe Mitchell's employment as a laborer from 1967 to 2002 at Brown & Root/KBR McIntosh, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants. The plaintiff alleges on or about June 13, 2016, her late husband first became aware that he developed lung cancer, an asbestos-induced disease, and that the disease was wrongfully caused. He died on Aug. 23, 2017, the suit states.

The plaintiff holds Bechtel, Cleaver-Brooks, Texaco, et al. responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available, and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks compensatory and economic damages of more than $50,000. She is represented by Gori, Julian & Associates PC in Edwardsville.
