Motorist alleges speeding driver caused I-255 collision

EDWARDSVILLE – A Jerseyville man alleges a speeding driver caused a collision on Interstate 255 in Madison County.

Clayton Warren filed a complaint on Jan. 30 in the Madison County Circuit Court against Derek Herzing, alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 18, 2017, he was in his 2010 Mercury Milan traveling northbound on Interstate 255 when the defendant recklessly operated his 2011 Chevrolet Silverado and caused it to strike his vehicle. 

As a result, Warren alleges he suffered physical injuries to his back, mid-back and other parts of his body, mental anguish, and medical expenses. 

The plaintiff alleges Herzing negligently drove his vehicle in excess of the posted speed limit, failed to keep a proper lookout and failed to yield to the right of way.

The plaintiff seeks judgment against the defendant in an amount greater than $50,000 plus costs of court.
