Tractor-trailer owner claims Speedco failed to properly install battery box, causing him to fall

EDWARDSVILLE – The owner of a tractor-trailer alleges he was injured when a Troy auto business failed to property reinstall a battery box.

Frederick Dunham filed a complaint on Jan. 23 in the Madison County Circuit Court against Speedco Inc., doing business as Speedco Truck, Lube and Tires, alleging negligence.

According to the complaint, the plaintiff alleges that on May 30, 2017, he was lawfully at the defendant's premises for the repair of his 2012 Mack tractor-trailer truck's battery box. The suit states that while attempting to enter his truck, his foot came into contact with the battery box and it suddenly moved, causing him to fall and sustain injuries. 

As a result, he claims he suffered injuries that caused him to be unable to perform his gainful occupation.

Dunham alleges Speedco failed to adequately install the truck's battery box and failed to exercise reasonable care in inspecting it before releasing the truck to him.

The plaintiff seeks judgment against the defendant in an amount that is fair and just for his damages and costs expended for this suit.
