Son alleges insurer failed to pay mother's life insurance benefits

EDWARDSVILLE – A man has filed suit against an insurance company over claims it wrongfully denied him coverage under a life insurance policy.

Justin Wallace filed a complaint on Dec. 11 in the Madison County Circuit Court against Globe Life Insurance Agency Inc., alleging breach of insurance policy.

According to the complaint, the plaintiff alleges that on Feb. 2, 2007, his mother Diane O. Parker died due to a closed head injury. While her life insurance policy issued by defendant was in full force and effect. The suit states the plaintiff was named as the policy's beneficiary.

The plaintiff alleges his request for payment under the policy was denied by the defendant on Dec. 11, 2007, and on Feb. 10, 2017. 

The plaintiff alleges that despite the medical certificate issued by a medical doctor stating that the decedent's cause of death was by accident, the defendant wrongfully claimed that Parker's death was caused by disease or sickness and would not pay the claim.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount of more than $100,000, plus attorney's fees, costs, and penalties as allowed by law.
