Woman alleges insurers failed to pay underinsured motorist coverage

EDWARDSVILLE – A woman alleges her insurance company failed to provide underinsured motorist coverage.

Rosemary McBride filed a complaint on Dec. 8 in the Madison County Circuit Court against Pekin Insurance Co. and The Farmers Automobile Insurance Association, alleging breach of contract.

According to the complaint, the plaintiff alleges that on Sept. 10, 2014, she was injured and sustained damages when she was involved in a motor vehicle accident with an underinsured driver. The suit states her vehicle was insured by Pekin Insurance Co. at the time of the accident and that she demanded arbitration of the coverage claim.

The plaintiff alleges the defendants failed to pay benefits to the insured and failed to agree to arbitration or name an arbitrator.

The plaintiff seeks judgment in an amount of more than $50,000.
