Widow sues Dana Cos., others over husband's cancer death

BELLEVILLE – A widow of a press operator/foreman alleges that exposure to products containing asbestos caused her late husband to develop lung cancer.

Elizabeth Garvin, individually and as special representative of the estate of Robert Garvin, deceased filed a complaint on Nov. 21 in the St. Clair County Circuit Court against CBS Corp., Dana Cos. LLC, Foster Wheeler Corp., et al. alleging negligence.

According to the complaint, the plaintiff alleges that at various times during plaintiff's decedent Robert Garvin's career life as a press operator and foreman from 1962 to 2002 and during his military career from 1964 to 1970, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. 

The suit states that on or about Feb. 26, 2015, decedent first became aware that he developed lung cancer, an asbestos-induced disease, and that the disease was wrongfully caused. He died on July 14, the suit states.

The plaintiff holds CBS Corp., Dana Cos. LLC, Foster Wheeler Corp., et al. responsible because the defendants allegedly included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks judgment against defendants in an amount of more than $50,000. She is represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
