Homeowners allege City of Alton failed to repair storm sewer

EDWARDSVILLE — Property owners are suing the City of Alton for allegedly allowing the storm sewer to fall into a state of disrepair.

Tara Lefler and Mike Lefler filed a complaint on Nov. 3 in the Madison County Circuit Court against the City of Alton, alleging it failed to exercise ordinary care to maintain its property in a reasonably safe condition for use.

According to the complaint, homeowners allege that on March 6, they sustained considerable damage to their property due a storm sewer falling into disrepair. 

As a result, they claim they became liable for large sums of money and lost all marketable value of the property. 

The plaintiffs allege The City of Alton failed to repair the storm drain and prevent further subsidence, ignored prior complaints about the condition of the storm drain and failed to warn of the damage to come.

The plaintiffs request a trial by jury and seek judgment in the amount in excess of $125,000 and such additional amounts as the jury and out shall deem proper and costs of suit.
