Homeowners allege Country Mutual Insurance refused to pay for hail damages

Insurance 07

EDWARDSVILLE – A Glen Carbon couple alleges their insurer has refused to pay for damages to their roof caused by a hail storm.

David & Jennie Stanko filed a complaint on Sept. 28 in the Madison County Circuit Court against Country Mutual Insurance Co., alleging breach of contract.

According to the complaint, the couple alleges that on June 15, 2011, their home sustained hail damage. They allege the defendant's hired engineering company incorrectly determined that only portions of the roof were damaged. They also claim the defendant has refused to repair or replace for the cedar shakes that were allegedly damaged.

The plaintiffs allege the defendant refused to repair or pay for the damages without any reasonable grounds to do so.

The plaintiffs seek judgment in an amount of more than $51,000, plus attorney fees, court costs, and any other relief deemed just and proper.

They are represented by Andrew S. Malloy of Malloy Law Offices LLC in St. Louis.
