Woman sues The Nature Institute after falling off wagon

By Noddy A. Fernandez | Aug 29, 2017

EDWARDSVILLE — A woman is suing The Nature Institute after she allegedly fell off a wagon during an Earth Day festival.

Janice M. Goodwin filed a complaint on Aug. 24 in the Madison County Circuit Court against The Nature Institute, alleging the defendant failed to operate a UTV/wagon with due care and caution.

According to the complaint, the plaintiff alleges that on April 16, 2016, she was seated on a wagon being pulled to transport passengers to attend defendant's 5th Annual Riverbed Earth Day Festival. She claims the UTV's driver suddenly accelerated causing her to fall off onto the ground.

As a result, Goodwin claims she suffered physical injuries, lost wages and incurred medical expenses.

The plaintiff alleges The Nature Institute failed to keep the UTV/wagon under proper control, failed warn of the dangerous condition of the wagon and failed to give any notice, signal or waning of sudden accelerations.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, plus costs of suit, and any other further relief the court deems just and proper.

She is represented by Craig J. Jensen of MeyerJensen, PC in Alton.
