Grain company alleges horse feed manufacturer failed to make payments

EDWARDSVILLE — A grain and field bean company is suing a horse feed manufacturer for allegedly failing to make payments.

Kenson Grain Company, LP as assignee of McClaskey Grain Company, Inc., filed a complaint on Aug. 25 in the Madison County Circuit Court against McClaskey Feed Company, Inc., alleging that the defendant violated the agreed contract despite plaintiff performing all obligations under the parties' agreement.

According to the complaint, the plaintiff alleges that between October 2013 and December 2015 they sold and delivered oats to the defendant on an open account. Kenson claims that it has performed all obligations and satisfied all conditions under agreement but has not received payment requested in its invoices. 

The plaintiff alleges the defendant failed to pay the balance due despite demand amounting to $657,440.26.

The plaintiff requests a trial by jury and seeks judgment for the sum of $657,440.26, plus pre-judgment interest, costs of collection and further relief the court deems just.
