Godfrey property owner claims resident failed to remedy drainage pipe system

EDWARDSVILLE – A Godfrey property owner alleges a poorly designed drainage system has caused water to pool on his property.

Jason Clayton filed a complaint on July 24 in the Madison County Circuit Court against David Sinclair seeking injunction.

According to the complaint, the plaintiff owns a house on St. Anthony's drive, the defendant's property is on Roach Road and the plaintiff's property is uphill and upstream from the defendant. The suit states there is a watershed and valley that leads from the plaintiff's property past the defendant's property and that the defendant or his predecessor constructed a dam across it.

The suit states that a drainage system was constructed within the dam and that it inadequately designed, constructed and insufficient to carry the flow of surface water that accumulates in the watershed. The plaintiff alleges because of this, a cesspool has formed upstream and has spread onto his property. 

The plaintiff requests a trial by jury and seeks injunction requiring stop blocking the natural flow and remove all obstructions to the natural flow of the surface water on property. He also requests $100,000 in damages. He is represented by Robert D. Larson of Robert D. Larson in Alton.
