Motorist alleges injuries from head-on collision on Illinois Route 13

BELLEVILLE — A motorist is suing another driver, alleging the defendant negligently caused a March crash on Illinois Route 13.

Emily Noethen filed a complaint on May 1 in the St. Clair County Circuit Court against Austin Cheek, alleging he failed to exercise ordinary care for the safety of other motorists and their vehicles.

According to the complaint, the plaintiff alleges that on March 30, 2017, she was driving in an easterly direction along Illinois Route 13 when the defendant's vehicle crossed the center line into the westbound land and struck her vehicle head-on. 

As a result, Noethen claims she sustained severe and permanent injuries and lost large sums of money for her medical treatment. 

The plaintiff alleges Cheek drove the vehicle at a speed that was greater than reasonable, failed to keep the vehicle under proper control and failed to apply brakes in order to avoid colliding with the plaintiff's vehicle.

The plaintiff requests a trial by jury and seeks judgment in a sum in excess of $50,000, plus costs of the action any other further relief the court deems just and appropriate.
