Man claims Country Casualty failed to cover fire damage at Millstadt property

BELLEVILLE — A homeowner is suing Country Casualty Insurance Company for allegedly refusing to cover damages from a fire.

Thomas D. Swearengin, who owns the subject property in Millstadt, filed a complaint on March 27 in the St. Clair County Circuit Court, alleging the insurer denied his claim without due cause and proper investigation.

According to the complaint, the plaintiff alleges that on Feb. 22, 2016, while his insurance policy was in effect, his insured residence and personal property suffered loss caused by fire and smoke. Swearengin states that he filed a claim and furnished defendant with due proof of the loss. 

He alleges the defendant failed and refused to pay the sum owed to the plaintiff.

The plaintiff requests a trial by jury and seeks damages in an amount greater than $50,000, plus interest, costs of this suit, attorney's fees and all other relief as the court may deem proper.
