Man blames wife's death on exposure to asbestos fibers

Asbestos 10

BELLEVILLE — A widower is suing Armstrong Pumps Inc., Aurora Pump Co., Borg-Warner Morse Tec LLC, et al, asbestos containing product manufacturers, alleging insufficient measures were taken to prevent injuries and death.

Perry Dietiker, individually and as special administrator of the estate of Veronica Dietiker, deceased, filed a complaint on Feb. 1, in the St. Clair County Circuit Court against the defendants, alleging that they breached their duty to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiff alleges that, during the course of Veronica Dietiker's employment, she was exposed to, inhaled, ingested and absorbed large amount of asbestos fibers emanating from certain products manufactured by defendants, which was ultimately connected with her death from lung cancer. The plaintiff holds Armstrong Pumps Inc., Aurora Pump Co., Borg-Warner Morse Tec LLC, et al responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available, and failed to provide adequate warnings and instructions on how to safely use their products containing asbestos fibers.

The plaintiff requests a trial by jury and seeks judgment against the defendants in a sum in excess of $50,000, as and for economic damages that will fairly compensate decedent's injuries. He is represented by Randi L. Gori and Barry Julian of Gori, Julian & Associates PC in Edwardsville.
