EAST ST. LOUIS — Two consumers have filed a class-action lawsuit against Inventure Foods Inc., a snack chips manufacturer, for allegedly providing a misleading ingredients list.
Shannah Burton and Michelle Blair, individually and on behalf of all others similarly situated, filed a complaint on Feb. 8 in the U.S. District Court for the Southern District of Illinois against Inventure Foods, Inc., alleging the snack chips manufacturer violated the Illinois Consumer Fraud and Deceptive Business Practices Act.
According to the complaint, the plaintiffs allege the defendant misled consumers into thinking its products have less sugar than they actually contain by listing Evaporated Can Juice, or ECJ, as an ingredient in its products. The plaintiffs allege ECJ is "sugar in disguise."
The plaintiffs claim they were damaged for paying extra for products that were actually worth less than they were represented.
The plaintiffs request a trial by jury and seek an order certifying this case as a class action and appointing the plaintiffs as class representative and their counsel as class counsel, an award for compensatory damages, pre- and post-judgment interest, attorneys’ fees and costs and all other relief as may be just and proper.
