EAST ST. LOUIS — A Walnut Hill woman is suing her former employer, an assisted living center, for allegedly terminating her employment following medical leave.

Dee Ann Heltsley filed a complaint on Feb. 7 in the U.S. District Court for the Southern District of Illinois against Provision Living Associates, LLC, doing business as GreenTree at Mt. Vernon, alleging the facility violated the Family and Medical Leave Act (FMLA).

According to the complaint, Heltsley alleges that on Aug. 13, she injured her foot and was ordered to take four weeks off work by her orthopedist. She was unable to perform her job and took FMLA leave. She was terminated on Aug. 19 for too many absences.

As a result, she claims she suffered lost of wages and benefits.

Heltsley alleges GreenTree retaliated against her by terminating her employment for taking FMLA leave.

Heltsley requests a trial by jury and seeks judgment in her favor and against the facility for unpaid wages and benefits, interests and damages, including reinstatement of employment, as well as any other relief this court deems just and proper.

She is represented by Ryan D. Rich of Wham & Wham Lawyers in Centralia.
