Painting contractor alleges inflated refuel charge

EDWARDSVILLE - A painting contractor is suing Sunbelt Rentals Inc., an equipment rental company, citing alleged unfair and deceptive trade practices.

Quality Assured Industrial Coatings LLC, individually and on behalf of all others similarly situated, filed a complaint on Dec. 29 in the Madison County Circuit Court against Sunbelt Rentals Inc., alleging the equipment rental company violated the Illinois Consumer Fraud and Deceptive Business Practices Act.

According to the complaint, the plaintiff alleges the defendant unlawfully charged more for refueling than its actual costs. Quality Assured also alleges Sunbelt Rentals did not consider changes in the retail price of fuel.

As a result of Sunbelt Rental's conduct, Quality Assured claims it was damaged by paying inflated and unlawful fees.

The plaintiff requests a trial by jury and seeks full restitution of the refueling charges, an order enjoining defendant from misleading plaintiff in the future, award for damages, litigation costs and such other just and equitable relief.
