BELLEVILLE — A woman is suing St. Clair Nissan after she allegedly drove a vehicle off the lot and it displayed mechanical problems.
Phyllis Robinson-Combs filed a complaint on Dec. 9 in St. Clair County Circuit Court against St. Clair Nissan Inc., alleging the car dealership violated the Illinois Consumer Fraud and Deceptive Business Practices Act.
According to the complaint, Combs alleges that on Oct. 28, she purchased a 2010 Dodge from the defendant. Shortly after being driven off the lot, she claims the vehicle displayed mechanical problems and the dealership has not upheld the warranty. She also claims that the handling of a fee in the transaction violated the law.
Combs alleges St. Clair Nissan failed and refused to accept the return of the vehicle and to provide a refund.
The plaintiff requests a trial by jury and seeks compensatory damages in excess of $50,000, plus attorney's fees and costs of this suit.
