Woman sues pet owners after dog allegedly bit her

BELLEVILLE — A woman is suing two pet owners after a dog allegedly bit her, citing alleged insufficient measures were taken to prevent injuries and negligence.

Anita Nicholson filed a complaint on Oct. 18, in the St. Clair County Circuit Court against Dave and Kim Forte alleging that the pet owners violated the Animal Control Act.

According to the complaint, the plaintiff alleges that, on Dec. 13, 2014, she was outside her residence with her husband looking at their Christmas lights when they heard dog barking coming from behind them. When they saw the dog coming towards them, they claim they attempted to run inside their house. Nicholson claims she fell and sustained significant injuries that resulted pain and suffering, disability and incurred medical expenses.

The plaintiff allege the defendant failed to maintain proper control of their dog and failed to keep their dog in a secured area.

The plaintiff requests a trial by jury and seeks compensation for an amount greater than $50,000, plus costs for this action and all other relief as the court deems equitable. She is represented by Dustin S. Hudson of Neubauer & Johnson in Fairview Heights.
