Mother, daughter accuse estate planners of negligent misrepresentation

BELLEVILLE — An Illinois mother and daughter are suing an attorney and fiduciary, alleging breach of duty.

Brenda Knuckles, as guardian of the estate of Angela Knuckles Stafford, a disabled adult, filed a lawsuit July 8 in St. Clair County Circuit Court against Valroy Binsbacher and Binsbacher & Griffithe LLC, alleging they negligently misrepresented Brenda Knuckles and her late husband Donald E. Knuckles Sr.

According to the complaint, the plaintiffs suffered financial damages and were caused to incur considerable expenses in attorney fees, costs and loss of benefits in excess of $50,000 following the death of Donald E. Knuckles May 25, 2012. 

The plaintiff alleges the defendants failed to review The Donald E. Knuckles Trust and divorce decree and failed to employ the requisite knowledge and skills to properly advise their clients and failed to disclose a conflict of interest in the trust and other clients.

Brenda Knuckles and Angela Knuckles Stafford seek a trial by jury and judgment of more than $50,000. They are represented by attorney Bernard J. Ysura of Cook, Ysura, Bartholomew, Brauer & Shevlin LTD in Belleville.
