Customer alleges lounge owners' negligence led to injuries

EDWARDSVILLE — A customer is suing the owners of a Staunton bar, alleging they were negligent in preventing injuries to the plaintiff from another patron. 

Amanda Thacker filed a lawsuit June 16 in Madison County Circuit Court against Rock Bottom LLC, Mike Lovsey, Billie Lovsey Secrest, The Dawg Haus Bar Inc., Gay Whiteside and Ron Whiteside, alleging they violated the Dram Shop Act.

According to the complaint, on April 2, Thacker suffered serious injuries in various parts of her body after being attacked by a patron of Rock Bottom in Staunton. The suit says she will be forced to pay for hospital, medical and surgical expenses. 

The plaintiff alleges the defendants provided the intoxicating liquors to Gary Sies, which caused him to physically attack and batter Thacker. The suit says the defendants failed to take reasonable actions to protect against misconduct of a third party, failed to remove violent patrons from its premises and admitted the presence of people who were vicious and intoxicated.

Thacker seeks a trial by jury, judgment of more than $50,000, plus legal costs,. She is represented by attorney John H. Hustava of Collinsville.
