Man alleges wife died at hospital due to negligence

BELLEVILLE – A man who is personal representative of his deceased wife's estate is suing over her alleged wrongful death while in a hospital.

John Whaley, as personal representative of the estate and surviving spouse of Candace Whaley, filed the suit April 1 in St. Clair County Circuit Court against Washington County Hospital and several other medical-care providers.

According to the complaint, Candace Whaley died April 1, 2014, after going into cardiac arrest at Washington County Hospital. 

John Whaley claims the defendants negligently failed to adequately treat her heart arrhythmia, failed to adequately resuscitate her during cardiac arrest and failed to properly treat and manage the patient.

As a result, Candace Whaley went into respiratory failure, full cardiac arrest and cardiac arrhythmia, according to the complaint.

A wrongful death count against Dr. Thomas Coy, other listed physicians and Family Physicians of Southern Illinois arises from their alleged failure to properly treat the deceased's diabetes, which also led to her death, the complaint states.

John Whaley claims he has suffered permanent damage from loss of consortium from his wife and has become liable for large sums of medical and funeral expenses, the suit asserts. He seeks judgment against all defendants for a total of 14 counts in an amount greater than $75,000 plus court costs. He is represented by Margaret J. Lowery of Lowery Law PC in Belleville.
