Woman alleges injuries from fall in Dollar Tree

BELLEVILLE – A customer claims she fractured her right wrist and hip when she slipped and fell at Dollar Tree.

Mildred Delashmit filed the suit March 14 in St. Clair County Circuit Court against Dollar Tree Stores Inc. and Fairview Heights Improvements LLC.

On April 1, 2014, the plaintiff alleges she was shopping at the Dollar Tree located at 10850 Lincoln Trail in St. Clair County when she allegedly slipped and fell on liquid that had been left unattended at the entrance to the store.

Fairview Heights Improvements is the owner, operator and maintenance company of the property where Dollar Tree is located.

The defendants were allegedly negligent by failure to clean or remove the liquid from the public area of the store, failure to warn the plaintiff and other customers of the dangerous condition, failure to create or enforce suitable guidelines for the inspection and maintenance of the premises, failure to conduct surveillance of the premises to identify and remove the dangerous conditions, failure to remove mats saturated with water and using inadequate mats for absorption in entryways.

As a result of the alleged negligence of the defendants, the plaintiff claims she slipped and fell to the ground and fractured both her right wrist and right hip. She alleges she has incurred medical expenses and will do so into the future, the suit states.

The plaintiff seeks an amount in excess of $50,000 from each defendant, plus court costs. She is represented by Lanny Darr of Darr Law Offices Ltd. in Alton.
