Suit says water-soaked mat in floor led to injury

EDWARDSVILLE – A customer is suing over injuries she allegedly sustained when she slipped and fell on a water-soaked mat at a store. She is citing negligence.

Phyllis A. Oster-Benton filed the suit March 2 in Madison County Circuit Court against Shop 'N Save Warehouse Foods Inc.

On March 27, 2014, the plaintiff was shopping at the defendant's location in East Alton, according to the suit, which goes on to allege that she slipped and fell when a floor mat saturated with water slid from under her feet, causing an injury.

The accident occurred because of the following negligence by the defendant, according to the suit: It allowed a floor mat saturated with water to be on the floor, it failed to replace the floor mat, it failed to warn customers of the floor mat, and it permitted a hazardous condition to exist on the floor.

As a result of that alleged negligence, the plaintiff has been permanently injured, especially her wrist, she will continue to suffer physical pain and mental anguish, she will continue to pay large sums of money for medical care, she will be unable to continue her usual activities, she has lost income and has become disabled.

The plaintiff seeks judgment against the defendant in a sum in excess of $50,000, plus court costs and other relief the court deems appropriate. She is represented by Gregory M. Tobin of Pratt & Tobin PC in East Alton.
