Collection agency alleges Madison County man owes nearly $53,000

EDWARDSVILLE – A collection agency is suing a Madison County man, alleging breach of contract over a debt owed for an equipment lease.

CACH LLC filed the lawsuit Feb. 16 in Madison County Circuit Court against Michael Simon, alleging breach of contract.

According to the complaint, on May 16, 2013, Simon entered into an equipment lease issued by General Electric Capital Corporation and the amount due on the account is $52,721. Furthermore, the lawsuit says, the defendant defaulted on his obligation and General Electric Capital charged off the account. CACH became owner of the charged off account as part of a purchase plaintiff made, the suit says.

The suit further states all credits and payments have been properly applied, and the defendant is not entitled to any additional credits or set-offs, meaning the balance of nearly $53,000 is currently due and owing. The complaint states the plaintiff has made demand on the defendant to pay the balance due and that demand has been refused.

CACH seeks judgment for $52,721, court costs and other relief the court deems fair and equitable. It is represented by Mandarich Law Group LLP of Chicago.
