Class-action status sought in suit against Just For Men

BENTON – A consumer is seeking class-action status in a suit over injuries allegedly resulting from the use of a male hair care product.

Garnett Davis, on behalf of himself and all others similarly situated, filed the suit Feb. 16 in the U.S. District Court for the Southern District of Illinois against Combe Inc., Combe Products Inc., Combe Laboratories Inc. and Combe International LTD, citing strict products liability, negligence, breach of express warranty, breach of implied warranty, negligent representation and fraud.

The defendants manufacture and sell Just For Men, a product intended to dye gray hair to a darker color, the suit states. Even if the product is used as directed, the defendants failed to adequately warn against the negative effects and risks associated with using it, the suit states.

Use of the product creates an unnecessary risk of burns, scarring, allergic reactions, anapyhlactic shock, skin depigmentation and other severe injuries, the suit says.

In addition to a trial by jury for the plaintiff and class members, the plaintiff seeks certification of a class action, compensatory and punitive damages, interest and penalties, injunctive or declaratory relief, court costs, interest and attorney fees, and other relief the court deems just and proper.
