Pharmacist sues O'Fallon Pharmacy Medicine Shoppe for wrongful termination

BELLEVILLE – The former president of a pharmacy corporation is suing his former employer, alleging wrongful termination.

Mark Walz filed a lawsuit Jan. 12 in St. Clair County Circuit Court against MDM Healthcare Inc., doing business as O'Fallon Pharmacy Medicine Shoppe, Melissa Epps and Deann Rallo. 

According to the complaint, Walz is a pharmacist and claims he is the president of the plaintiff corporation. However, he alleges the the business was not run as a proper corporation under Illinois law.  The suit says the individual defendants conspired to deprive Walz of his equity in the corporation and terminated his employment without a proper corporate meeting.

The plaintiff alleges wrongful termination and claims he is entitled to receive the market value of his shares and the equity and hard assets of the business. He also says he is entitled to receive 40.5 percent of the net profits--the amount of shares he owns--of the business as long as he is a shareholder, the suit states.

The complaint alleges the plaintiff has sustained damages as a result of the wrongful termination, including loss of salary and loss of his equity and shares in the business, for which he paid $55,000.

Walz seeks damages of at least $50,000 from each defendant, plus court costs and attorney fees, and return of the value of his stock in the corporation. He is represented by attorney Eric M. Rhein of Belleville.
