A ravern blamed for serving a man alcohol before he crashed into a Godfrey house, killing the man inside, responded to the complaint denying the allegations and demanding a trial by jury.
Defendant Beer Barrel Pub, Inc. filed the answer through attorney Stephen J. Moore of Galloway, Johnson, Tompkins Burr & Smith PC in St. Louis on Sept. 13, stating, “Beer Barrel Pub, Inc. denies any allegations not specifically admitted herein and any allegations contained within the prayers for relief.”
According to the complaint filed in Madison County, Brian Bushnell, individually and on behalf of the estate of his father Marlin F. Bushnell, claims defendant Jacob L. Fickle was driving on Saturn Drive on Jan. 13 when he left the road and drove his car into Marlin Bushnell’s home. Brian Bushnell claims his father died from the injuries he received in the crash.
Fickle is accused of being drunk when he caused the crash.
Brian Bushnell claims Beer Barrel Pub in Godfrey is responsible for his father’s death for serving Fickle alcohol just before the incident, which is a violation of Illinois’ Dram Shop Act.
On Sept. 17, Fickle filed a letter stating that he has been incarcerated in the Madison County Jail since the alleged crime committed on Jan. 13.
He also claims he did not have a counsel or anyone to appear before the court on his behalf. He requested advice on how to continue with the case or how to arrange transportation to appear himself.
Bushnell seeks a judgment of more than $200,000.
Circuit Judge Andreas Matoesian scheduled a case management conference for Oct. 30 at 9 a.m.
