Highland accident causes permanent injuries, suit claims

A woman claims she suffered severe and permanent injuries after a driver failed to yield at a stop sign and struck her vehicle.

Barbara J. Weis and Curtis J. Weis filed a lawsuit Aug. 8 in Madison County Circuit Court against Byron E. Barker as next friend of Tenor B. Barker, who is a minor.

In their complaint, the Weises allege Barbara J. Weis was driving north on Arkansas Road at its intersection with Bellm Road in Highland on June 28, 2013, when minor Tenor B. Barker, who drove west on Bellm Road, disregarded a stop sign and struck her vehicle.

Because of the collision, Weis suffered severe and permanent injuries, incurred medical costs, lost wages, experienced great pain and suffering and sustained damages to her automobile, according to the complaint. She also incurred medical bills to treat her son, minor Patton Weis, who was riding in the vehicle at the time, the suit states.

Curtis J. Weis, who is married to Barbara J. Weis, has been deprived of his wife’s support and services and has incurred medical costs, according to the complaint.

The plaintiffs blame Tenor Barker for causing the collision, saying he failed to follow a traffic stop sign, failed to yield the right-of-way, failed to keep a proper lookout, drove in a reckless manner, drove too fast, failed to sound his horn to avoid a collision and failed to reduce his speed to avoid a collision.

In their complaint, the plaintiffs seek a judgment of more than $100,000, plus costs.
