Greenmount Road accident leads to St. Clair County suit

A woman has filed suit against the driver who she claims rear-ended her vehicle.

Janine Cox claims she was driving north on Green Mount Road near its intersection with Cascade Lake in Shiloh on Dec. 13, 2011, when she attempted to make a left-hand turn onto Cascade Lake. Suddenly, defendant Brett Tady, who was driving behind her, violently collided with the back of her vehicle, according to the complaint filed July 22 in St. Clair County Circuit Court.

Because of the collision, Cox suffered severe and permanent injuries to her neck, back, chest and coccyx; was prevented from attending to her usual affairs; and lost wages, the suit states. She also suffered a permanent disability and endured great pain, the complaint says.

Cox blames Tady for causing the collision, saying he negligently failed to reduce his speed to avoid a collision, drove too fast, failed to apply his brakes to avoid a collision and failed to keep a proper lookout.

In her complaint, Cox is seeking a judgment of more than $50,000, plus costs.

Bernard J. Ysursa of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville will be representing her.

St. Clair County Circuit Court case number: 13-L-376.
