Low back injuries claimed in suit against Illinois Central

A man has filed suit against the railroad company where he claims he was working when he sustained low back injuries.

Dewayne Bassen claims he was working as a painter for defendant Illinois Central Railroad Company from 1998 until the present. During his career, due to the nature of his job, Bassen suffered lower back injuries, according to the complaint filed April 10 in St. Clair County Circuit Court.

In addition to his injuries, Bassen suffered pain and mental anguish, was forced to undergo medical treatment and lost wages and fringe benefits, the suit states. He also incurred medical costs and experienced an impaired ability to work, labor and enjoy the pursuits of happiness, the complaint says.

Bassen blames Illinois Central for causing his injuries, saying it negligently failed to provide him with a safe place to work, failed to provide safe conditions or methods for performing his work, failed to enact a comprehensive ergonomics program, failed to provide him with safe tools and equipment, failed to provide him with protection from exposure to cumulative trauma and failed to provide adequate training, among other negligent acts.

Bassen will be represented by Holland, Groves, Schneller and Stolze.

St. Clair County Circuit Court case number: 13-L-192.
