Don's No Man's Land sued over video gaming exclusivity agreement

An East Alton bar is being sued for allegedly breaking an exclusivity contract by allowing a video gaming company to set up machines on its property.

Midwest Electronics Gaming LLC and AAA Gaming LLC filed a lawsuit April 12 in Madison County Circuit Court against Don's No Man's Land Inc.

Don's No Man's Land bar signed an exclusive 5-year location and device agreement in July 2009 with JT's Vending Inc., according to the complaint. In May 2010 the rights to the No Man's Land gaming contract were sold by JT's Vending to AAA Gaming and again, in July 2012, transferred from AAA Gaming to Midwest Electronics. As part of that transfer, Midwest allegedly agreed to pay AAA Gaming $15,000 for the exclusive video gaming rights.

According to the plaintiffs, Don's No Man's Land has since allowed another gaming company, Illinois Gold Rush Inc., to place video gaming machines in its bar, a violation of the exclusivity contract with Midwest Electronics. The bar is accused of breach of contract and   and AAA Gaming ask for more than $50,000 in damages, interest and court costs.

Attorneys Thomas J. Arkell of Bloomington Michael J. Nester of Belleville along with William M. Gantz and Anthony T. Eliseuson of Chicago represent the plaintiffs.
