Wreck on Route 3 caused by distracted driver, suit says

Two people claim they sustained various injuries after a car careened into their vehicle in an attempt to avoid a collision.

Andra Journey and Dion Patrick filed a lawsuit March 8 in Madison County Circuit Court against Monica R. Dickens and Joseph D. Pitre.

In their complaint, the plaintiffs allege Journey was driving a 1997 Lincoln Town Car Signature south on Illinois Route 3 on March 11, 2011, at the intersection of Illinois Route 3 and West Chain of Rocks Road. As they were approaching the intersection, Dickens exited a ramp from Interstate 270 and crossed two lanes of traffic in front of Pitre, according to the complaint. In turn, Pitre lost control of his vehicle and struck the rear passenger’s side of Journey’s, the suit states. He struck Dickens’s car for a second time on the front end, the complaint says.

Because of the accident, Journey suffered back, neck, shoulder and left knee injuries; endured severe physical pain and mental and emotional distress; and incurred medical costs. Meanwhile, Patrick suffered right knee injuries, experienced physical pain and suffering and incurred medical costs, the suit states.

Journey and Patrick are blaming Dickens for causing the collision, saying she failed to concentrate on driving, failed to keep a proper lookout, drove in a distracted and unsafe manner and drove in a reckless fashion.

The plaintiffs also name Pitre as a defendant, saying he drove too fast, failed to sound his horn or to warn of his approach and failed to keep proper control of a vehicle.

In their complaint, the plaintiffs are seeking a judgment of more than $200,000, plus costs and other relief the court deems just.

They will be represented by Brian P. Millikan of Millikan Wright in St. Louis.
