In recently filed court documents, a federal prisoner is blaming his daughter for causing him to lose his home during his incarceration, saying she failed to pay real estate taxes on the property, even though he provided her with sufficient means to do so.

Timothy Baker filed a lawsuit March 4 in Madison County Circuit Court against Michelle Dawson.

In his complaint, Baker alleges he was living at 302 McNair in Madison until his incarceration in 2009. In the meantime, Baker declared Dawson power of attorney and asked her to pay all of the bills relating to his home, according to the complaint.

He had also asked her to maintain the home through his son, Christopher Baker, who was living in the house, the suit states.

However, at some point, Dawson stopped paying bills associated with the property, including real estate taxes, the water bill, the trash bill, the sanitary bill, the telephone bill and the electric bill. In total, Timothy Baker now owes $6,610.67 for the unpaid costs, the complaint says.

Because Dawson failed to pay property taxes, Timothy Baker claims he will most likely lose the property to tax deed in August of 2013.

He claims he has lost additional property to thieves who ransacked his home after his son abandoned the property. In addition, Dawson got rid of property without Timothy Baker’s permission, causing him losses of $64,060, according to the complaint.

He claims his losses, including real and personal property, total $141,670.67.

In his complaint, Timothy Baker seeks the total amount of losses he claims he endured, plus punitive damages and other relief the court deems just.

Timothy Baker will be appearing pro se and has asked to be allowed to utilize a video camera to access court hearings because he is not allowed to leave prison.

He is incarcerated at the Federal Correctional Institution (FCI) in Seagoville, Texas. His release date is May 14, 2014.
