A woman is fighting a man’s lawsuit against her for allegedly running a red light and striking his vehicle.
Janet Jackson responded to the lawsuit through her attorney, Feb. 19, denying the allegations. She says the suit should be dismissed with prejudice.
Michael McIntosh claims he was driving on St. Clair Avenue near the intersection with 79th St., Jan. 4, 2011, when defendant Janet Jackson allegedly drove through a red light and struck his vehicle. He filed a complaint Jan. 3 in St. Clair County Circuit Court.
But according to Jackson, McIntosh failed to keep a careful lookout, failed to yield to the right of way and drove at an excessive rate of speed. She also claims he violated a traffic signal and failed to stop or slow down after he knew “there was a reasonable likelihood of a collision.”
Jackson’s response to the lawsuit also says McIntosh’s damages should be reduced in proportion to his comparative negligence.
McIntosh claims he suffered back, neck and head injuries; incurred medical costs of about $5,000; and suffered from an impaired ability to work.
A certificate of service was filed Feb. 21 stating the plaintiff’s interrogatories were sent to Jackson.
McIntosh is represented by Scott L. Kolker of Kolker and Germeroth in Clayton.
Jackson is represented by Beth Boggs and Brent Salsbury of Boggs, Avellino, Lach & Boggs in St. Louis.
The case is assigned to St. Clair County Circuit Judge Vince Lopinot.
