Man sues hauler over accident injuries

A man who was rear-ended by a tractor-trailer claims he suffered disability and disfigurement because of the collision.

Brian Orr filed a lawsuit Feb. 25 in Madison County Circuit Court against ABF Freight System, Carlos R. Singley and Garland Gehrke Trucking.

In his complaint, Orr claims he drove west on Interstate 270 in Chouteau Township on July 26, 2011, when Omer Momkine, who was driving a tractor-trailer for ABF, struck the back of the tractor-trailer traveling behind Orr. In turn, Singley, who was driving a tractor-trailer for Garland, rear-ended Orr’s vehicle, according to the complaint.

Because of the collision, Orr suffered disability and disfigurement, experienced pain and mental anguish, lost earnings and incurred medical costs, the suit states.

ABF Freight System and Garland negligently failed to keep a proper lookout, drove in such a manner as to strike another vehicle, failed to properly apply their brakes, failed to reduce their speed to avoid a collision and drove in a careless and reckless manner, the complaint says.

In his two-count complaint, Orr seeks a judgment of more than $100,000, plus costs.
