Man says ladder caused injuries

A man has filed suit against the company that manufactured a ladder, saying the stepping tool collapsed underneath of him, causing him to break ribs during the crash.

Patrick Hickey claims he was utilizing a ladder manufactured by defendant Werner Company on Oct. 2, 2011, when the ladder suddenly collapsed from beneath him.

Because of the incident, in addition to his broken ribs, Hickey became sick, sore, lame, disordered and disabled and suffered from ruptured discs, according to the complaint filed Feb. 4 in St. Clair County Circuit Court. He also suffered disability, experienced pain and suffering and lost wages, the suit states.

Werner negligently failed to warn users that its ladder was unstable because of defective leg braces and failed to warn that the ladder was unsafe for the rated weights, the complaint says.

In his complaint, Hickey is seeking a judgment of more than $50,000, plus costs.

James R. Williams of the Law Offices of Williams, Caponi and Foley in Belleville will be representing them.

St. Clair County Circuit Court case number: 13-L-62.
