Tenant seeks more than $400K in icy slip outside apartment

A man seeks to reclaim the more than $200,000 in medical costs he claims to have incurred after he slipped on snow and ice outside of his apartment complex.

Carl Brummund filed a lawsuit Jan. 25 in St. Clair County Circuit Court against State Realty Property Management Company, Kenneth Chitty and Donna Chitty.

In his complaint, Brummund alleges he was living at an apartment complex at 212 South Church Street in Belleville on Feb. 5, 2011, when he slipped on a snow-covered walkway.

Because of his fall, Brummund became sick, sore, lame and disordered; suffered extensive injuries to his right foot and ankle; and experienced pain and suffering, according to the complaint. He also incurred medical costs of $202,362, lost his earning capacity and suffered disability and disfigurement, the suit states.

Brummund blames the defendants for causing his fall, saying they negligently failed to properly supervise the common area, failed to keep the sidewalk in a safe condition, failed to routinely inspect the sidewalk and remove the snow from it, failed to maintain the roof and gutter systems on the property and allowed unnatural accumulations of ice and snow on the walkway, among other negligent acts.

In his complaint, Brummund seeks a judgment of more than $400,000, plus costs and other relief the court deems just.
