Windsor Mortgage seeks $1.2 million loan repayment

 

A company has filed suit against the Nevada company that it claims engaged in a fraudulent scheme to acquire properties.

Windsor Mortgage Holdings claims it lent Eric Tomasi $4.3 million to purchase properties at 901 Martin Luther King Dr.; 907 Martin Luther King Dr..; 913 Martin Luther King Dr.; and 420 North Ninth Street.

Later, Tomasi defaulted on his repayments to Windsor. Tomasi still owes the company about $1.2 million, the suit states. In turn, Windsor filed a lawsuit against him, according to the complaint filed Nov. 8 in St. Clair County Circuit Court.

Tomasi failed to repay the money he owed under the terms of the lawsuit, the complaint says. He attempted to evade repayment by transferring the properties to Martin Luther King Properties, which then transferred them to defendant Stellar Reo Properties, Windsor claims.

In addition to the money it claims it is owed, Windsor is seeking an order compelling the transfer of any real property held to it, plus pre- and post-judgment interest, attorney’s fees, exemplary and punitive damages and other relief the court deems just.
