Motorcyclist blames driver for causing Wood Alton accident

A Wood River driver is accused of crossing in front of a motorcycle and causing it to crash in West Alton.

Jason and Rachel Smith filed a lawsuit against Oliver Van Winkle Nov. 8 in Madison County Circuit Court.

Jason Smith says he was riding his Harley Davidson Sportster motorcycle north on U.S. 67 in April 2010. At the same time, Van Winkle was allegedly stopped at the eastbound stop sign on Riverlands Way, where it crosses U.S. 67.

As he neared the intersection of Riverlands Way, Smith claims Van Winkle pulled across the northbound lanes. Smith says, in his attempt to avoid a collision, he swerved and fell off the motorcycle. The bike allegedly ended up hitting the back of Van Winkle's car.

Smith and his wife, Rachel, are suing Van Winkle for negligence and loss of consortium. They seek more than $50,000 in damages for medical expenses, loss of income and court costs.

The Smiths are represented by attorneys Jennifer Suttmoeller and Leonard P. Cervantes of St. Louis. They ask for a jury trial.
