Greenmount Road driver blamed for failing to yield

An O’Fallon woman has filed suit against the driver who she claims attempted to make a left-turn and collided with her vehicle.

Cheryl A. Bergan claims she was driving south on Green Mount Road near its intersection with Central Park Drive on July 27 when defendant, Darrius D. Brown, who was driving a 2002 Chevrolet Trailblazer north on Green Mount Road, crossed into Bergan’s lane and struck her vehicle.

Because of the collision, Bergan suffered serious, severe and painful injuries; endured pain; was hindered and prevented from attending to her normal activities; and lost wages, according to the complaint filed Oct. 30 in St. Clair County Circuit Court. She also incurred property damages, the suit states.

Brown negligently failed to yield the right-of-way, failed to stop or swerve to avoid a collision, failed to keep a careful lookout for vehicles entering the intersection, failed to drive in a careful manner, failed to maintain control of her vehicle, drove with a suspended license and failed to drive in the right half of the road, the complaint says.

In addition to Brown, Bergan named Andreia Johnson as a defendant, saying she negligently allowed Brown to use her vehicle, even though she knew he had a suspended driver’s license.

In her two-count complaint, Bergan is seeking a judgment of more than $100,000, plus costs.
